TERMS OF SERVICE

1. ACCEPTANCE OF TERMS
By downloading, installing, or using the MaskAura application ("Service", "App", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately cease using the Service and uninstall the App.
AGE REQUIREMENT: You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years or older. We do not knowingly collect information from or direct any of our content specifically to children under 18.
2. SERVICE DESCRIPTION
MaskAura is a product of 698324248 PTY LTD. The Service may include one or more of the following capabilities, depending on the specific application:
(a) Encrypted Relay Technology: End-to-end encrypted data relay connections designed to protect the confidentiality, integrity, and origin-anonymity of your interactions with AI platforms and academic resources in transit. Only designated platform traffic is relayed through our encrypted infrastructure; all other internet traffic remains on your direct local connection.
(b) AI-Generated Intelligence: AI and machine learning-powered analysis, reports, summaries, scores, and insights generated from publicly available data sources. All AI-generated content is provided strictly for informational and educational purposes only.
(c) Data Aggregation and Display: Real-time and historical data aggregation from third-party providers, presented through dashboards, charts, and structured views.
The specific features available to you depend on which 698324248 PTY LTD application you are using. Available on iOS (Apple App Store), Android (Google Play Store), Windows (Microsoft Store), and macOS (Mac App Store). All user data is stored exclusively in Australia.
3. ACCOUNT REGISTRATION AND SECURITY
You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. Each account is limited to a specified number of concurrent device connections. You must notify us immediately of any unauthorized access or security breach.
4. PAYMENT AND ACCESS PERIODS
Payment Processing: All payments are processed through Stripe as single purchases. We do not process payments through app stores. Your payment card details are forwarded to Stripe at frontend for processing and are NEVER stored on our servers. We only retain transaction records (amount, date, status) for accounting purposes.
Access Period Packages: We offer various time-based access packages (e.g., 30 days, 90 days, etc.). Each purchase is a one-time payment for a specific access period. Prices displayed in Australian dollars (AUD). Access periods do NOT automatically renew — you must purchase a new access period before expiration to continue using the Service.
Account Access: You can access your account on any supported platform (iOS, Android, Windows, macOS) by logging in with your credentials.
5. REFUND POLICY
General Policy: Due to the nature of our Service, all sales are final. When you purchase an access period package, our infrastructure costs (server resources, bandwidth, processing capacity) are incurred immediately upon activation. These operational costs cannot be recovered once service access has been provided.
Important Notice: Refunds are generally not available for digital services after activation. This includes but is not limited to: change of mind, failure to use the Service, dissatisfaction with performance, account termination for policy violations, inability to access due to external factors (local network restrictions, platform policy changes, device compatibility), or user error.
Refund Requests: In exceptional circumstances and at our sole discretion, we may evaluate refund requests on a case-by-case basis. All refund decisions are final and non-appealable. To request consideration, contact company@maskaura.xyz within 7 days of purchase with your order details.
Approved Refunds: If approved, refunds are partial only (calculated based on infrastructure costs already incurred and service usage). Refunds are NOT processed through Stripe. You must provide valid government-issued identification (passport or driver's license) and corresponding bank account information for identity verification. Refunds are processed exclusively via Wise international bank transfer. Processing takes 5-10 business days after identity verification and bank details are confirmed. Original Stripe payment processing fees are non-refundable and will be deducted from any approved refund amount.
Legal Compliance: This policy does not affect your statutory rights under mandatory consumer protection laws where applicable.
6. ACCEPTABLE USE POLICY
You agree to use the Service only for its intended purposes as described in Section 2 and in accordance with all applicable laws and regulations.
You agree NOT to use the Service for: any illegal activities, distributing malware, unauthorized access to systems (hacking), harassment or threats, distributing child exploitation material, spamming or phishing, copyright infringement, DDoS attacks, circumventing access controls, or any activity that violates the rights of others. Accounts found violating this policy will be immediately terminated without refund.
7. SERVICE AVAILABILITY
We strive to maintain high uptime but do not guarantee uninterrupted service. Server availability may vary by location. Brief service interruptions for maintenance, updates, or technical issues may occur. We reserve the right to modify, suspend, or discontinue any aspect of the Service with notice when possible. Service interruptions do not entitle users to refunds except as outlined in Section 5.
8. INTELLECTUAL PROPERTY
All Service content, features, and functionality are owned by us and protected by copyright and trademark laws. You receive a limited, non-exclusive, non-transferable license to use the Service. You may not copy, modify, distribute, or reverse engineer any part of the Service.
9. PRIVACY AND DATA PROTECTION
Your privacy is important to us. Our Privacy Policy explains what data we collect, how we use it, and your rights. We only retain minimal data necessary for service operation.
10. LIMITATION OF LIABILITY
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
11. INDEMNIFICATION
You agree to indemnify and hold harmless MaskAura from any claims, damages, losses, and expenses arising from your use or misuse of the Service, your violation of this Agreement, or your violation of any applicable laws.
12. TERMINATION
You may terminate your account at any time. Termination does not entitle you to any refund for unused access periods. We may suspend or terminate your account immediately, without notice or refund, for violation of this Agreement, fraudulent activity, abuse of resources, or legal requirements. All outstanding amounts remain due upon termination.
13. DISPUTE RESOLUTION
This Agreement is governed by applicable law. Disputes shall be resolved through binding arbitration on an individual basis. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS-ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.
14. AFFILIATE PROGRAM
We may offer an affiliate/referral program. Affiliates earn rewards on referred customer payments. Reward rates and terms are subject to change. We reserve the right to withhold rewards for fraudulent referrals.
Affiliate Rewards: Payouts are processed only via Wise. Minimum withdrawal thresholds apply.
Prohibited Activities: False advertising, trademark misuse, spam, cookie stuffing, and other fraudulent techniques.
15. ACCOUNT DELETION AND DATA RIGHTS
Account Deletion: You may request account deletion at any time by contacting company@maskaura.xyz. Upon deletion, your account data will be permanently removed within 30 days, except where retention is required by law.
Data Access: You have the right to request a copy of your personal data. Contact company@maskaura.xyz to exercise this right.
Data Portability: You can export your account data before deletion by requesting it through our support channels.
16. APP PERMISSIONS
App Permissions (iOS/Android/Windows/macOS): The app may request the following permissions depending on its functionality:
- Network Access: Required to connect to our servers and third-party data providers
- Network Configuration: Required if the Service includes encrypted relay functionality to selectively route designated traffic through our infrastructure
- Notifications: Optional, for service alerts and access period expiration reminders
- Storage: Minimal, for app preferences and configuration
All permissions are used solely for service functionality. We do not access personal files, contacts, camera, microphone, or other sensitive device data unless explicitly required and disclosed.
17. MODIFICATIONS
We reserve the right to modify these Terms at any time. Changes will be effective 30 days after notice for existing users (via email or in-app notification). Continued use after changes constitutes acceptance. Major changes will require re-acceptance in the app.

19. PLATFORM COMPLIANCE
This Service complies with:

- Google Play Developer Program Policies
- Microsoft Store Policies
- Applicable laws in all jurisdictions where offered
Platform-Specific Terms: Your use is also governed by the terms of service of the platform from which you downloaded the app (Apple, Google, or Microsoft).
20. GOVERNING LAW
Governing Law: This Agreement is governed by the laws of Queensland, Australia. Disputes shall be resolved in courts within that jurisdiction.
21. SEVERABILITY
Severability: If any provision is invalid, the remainder remains enforceable.
22. ENTIRE AGREEMENT
Entire Agreement: This document supersedes all prior agreements.
23. COOPERATION WITH AUTHORITIES
Cooperation with Authorities: We may disclose your information if legally compelled (e.g., court order under Australia's Telecommunications Act 1997 or Surveillance Legislation Amendment Act 2021).
24. USER RESPONSIBILITY
User Responsibility: You must comply with all applicable laws, including export controls and sanctions (e.g., Australian Autonomous Sanctions).
25. AI-GENERATED CONTENT DISCLAIMER
Where the Service includes AI-generated content (including but not limited to reports, analyses, summaries, scores, estimates, and recommendations), the following terms apply:
(a) Not Professional Advice: AI-generated content does not constitute financial, investment, legal, medical, or any other form of professional advice. You must conduct your own independent research and consult qualified professionals before making decisions based on AI-generated content.
(b) No Guarantee of Accuracy: AI-generated content may contain errors, inaccuracies, outdated information, or misinterpretations. Scores, estimates, and analyses are statistical approximations and may not reflect actual conditions. Past performance or historical data referenced by the AI does not guarantee future results.
(c) AI Limitations: AI models have knowledge limitations, may hallucinate data points, and cannot predict future outcomes with certainty. All AI-generated outputs are probabilistic estimates, not guarantees.
(d) Third-Party Data: Data displayed in the application may be sourced from third-party providers and may be delayed, incomplete, or inaccurate. MaskAura does not independently verify the accuracy of all third-party data.
(e) No Automated Decision-Making: MaskAura does NOT use AI for automated decision-making that produces legal effects or similarly significant effects on users. AI-generated content is informational only and does not trigger any automated actions on your behalf.
(f) No Liability for AI Content: To the maximum extent permitted by law, MaskAura and its operators accept no liability for any losses, damages, or adverse outcomes resulting from reliance on AI-generated content provided through this Service.
26. COMPLIANCE WITH LOCAL LAWS
You are solely responsible for ensuring your use of the Service complies with all applicable laws and regulations in your jurisdiction, including but not limited to data protection laws, export control regulations, and any applicable professional or institutional policies.

Privacy First: We collect only the minimum data necessary to operate the Service. All user data is stored exclusively in Australia and never leaves Australian jurisdiction.

- Payment transaction records (amount, date, status only — card details handled exclusively by Stripe)

Location Data Disclosure: If the application accesses location data, it is used solely on-device (e.g., to select optimal server connections based on your approximate region) and is never transmitted to or stored on our servers.
Data Sharing: We do NOT sell your data. We do NOT share your data with advertisers. Limited sharing only with payment processors (Stripe, Wise) and email service providers for essential account communications.
Security: Data encrypted in transit and at rest using industry-standard encryption (TLS 1.3, Ed25519).
Data Storage Location: All user data stored exclusively in Australia. Any globally distributed infrastructure nodes do NOT store user data.

The only data collected is minimal connection metadata (connection timestamp and duration) solely for service operation and troubleshooting.
4. HOW WE USE YOUR INFORMATION
We use your information to: provide and manage the Service, process payments, authenticate access, provide customer support, detect and prevent fraud, optimize service performance, send service notifications, and comply with legal obligations.
We do NOT use any collected data for advertising, profiling, or any purpose beyond providing the Service.
5. HOW WE SHARE YOUR INFORMATION

Legal Requirements:

6. DATA RETENTION
Active Accounts: Account data retained while active; transaction records retained for 7 years (tax and accounting requirements — amount, date, status only, no payment card details); connection metadata retained for 30 days maximum.
Closed Accounts: Most data deleted within 30 days; transaction records retained for legal requirements (7 years); backups deleted within 90 days.
7. DATA SECURITY
We use industry-standard encryption (TLS 1.3, Ed25519), role-based access controls, regular security audits, DDoS protection, and secure server configurations. However, no security system is 100% impenetrable. You are responsible for protecting your account credentials.
8. YOUR PRIVACY RIGHTS
All Users:
- Access: Request a copy of your personal data
- Correction: Update or correct inaccurate information
- Deletion: Request deletion of your account and data
- Portability: Receive your data in machine-readable format
- Objection: Object to certain data processing activities

9. DATA STORAGE AND LOCATION
Data Storage: All user data, including account information, transaction records, and connection metadata, is stored exclusively in Australia. Our API server and database are both located in Australia and your data never leaves Australian jurisdiction.
Global Service Delivery: Where the Service operates globally distributed infrastructure (e.g., relay nodes, CDN endpoints), these nodes do NOT store any user data — they process requests in real-time only. Your personal information remains in Australia at all times.
Privacy Advantage: This architecture ensures your data is protected under Australian privacy laws while still providing global service access.
10. CHILDREN'S PRIVACY
Our Service is NOT intended for children under 18 years of age. We do not knowingly collect data from children. If you believe your child has provided us with data, contact us at company@maskaura.xyz.
11. DATA BREACH NOTIFICATION
In the event of a data breach, we will notify affected users within 72 hours where required by law, report to relevant authorities, and take immediate action to mitigate harm.
12. COOKIES AND TRACKING
We do NOT use cookies. Session authentication and user preferences are managed through secure server-side mechanisms without browser cookies. We do NOT use tracking technologies or analytics cookies.
13. AFFILIATE PRIVACY
If you participate in our affiliate program, we track referral relationships and process affiliate reward payments via Wise. We do not share referred users' personal information with affiliates without consent.
14. AI-GENERATED CONTENT AND DATA USAGE
Where the Service includes AI-generated content, the following data practices apply:
How AI Is Used: The Service may employ AI and machine learning models to generate content such as reports, analyses, summaries, scores, estimates, and insights from publicly available data sources. All AI-generated content is clearly identified as such within the application.
Data Inputs to AI Models: Our AI models process only publicly available data relevant to the Service's domain. Our AI models do NOT process your personal information, account details, authentication credentials, browsing history, search queries, app usage patterns, device information, location data, or contact lists.
Data Not Used for AI Training: Your personal data, account information, usage patterns, and interactions with MaskAura are NEVER used to train, fine-tune, or improve our AI models or any third-party AI models.
Third-Party AI Services: MaskAura may utilise third-party AI service providers for data processing and content generation. These providers receive only aggregated, non-personal data, are contractually prohibited from using any data for their own model training, are subject to data processing agreements that comply with applicable privacy laws, and do not receive, access, or process any user personal information.
AI Model Governance: AI-generated content is reviewed for quality and safety through automated filtering pipelines. We monitor AI outputs for systematic biases and periodically review generated content for accuracy. AI models may be updated periodically, and users will be notified of significant changes to AI capabilities.
User Controls: AI-generated content is not personalised based on individual user behaviour or preferences — all users receive the same content. Users can report inaccurate or problematic AI-generated content through the in-app support system.
AI Compliance: This AI implementation complies with Apple App Store Review Guideline 5.6.1 (AI/ML transparency requirements), Google Play AI-Generated Content Policy, EU AI Act transparency obligations for AI-generated content, and Australian AI Ethics Principles (voluntary).
15. CHANGES TO THIS POLICY
We may update this Privacy Policy periodically. Material changes will be notified via email or service notification. Continued use after changes constitutes acceptance.
